Mr. Cowper prevailed on both motions which led to significant victories in two separate litigations and allowed thousands of cases to proceed to trial. Mr. Cowper has been instrumental in continuing to strengthen this body of law in California (and a number of other States) involving a claim for failure-to-warn the FDA which allows plaintiffs to defeat a preemption defence raised in cases involving Class III medical devices in the United States.
